This Terms of Service agreement (“Agreement”) is entered into between you (“you,” “your,” or “User”) and NoMoreAnalog, a Texas limited liability company (“Formcast,” “we,” “us,” or “our”). This Agreement governs your access to and use of the Formcast services including all websites, applications, APIs, and related tools (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Description of Service

Formcast allows users to collect data through frontend forms, transmit that data via API to our platform, store the data securely, and forward it to designated third-party destinations as configured by the user.

2. Eligibility

The Service is intended for use by individuals who are at least 13 years old. By using the Service, you represent and warrant that you have the legal capacity to enter into this Agreement. We do not knowingly collect information from children under the age of 13.

3. User Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Legal Compliance: You are solely responsible for ensuring that your use of the Service and any data you collect complies with all applicable laws and regulations, including data privacy and protection laws.
• Endpoint Configuration: You are responsible for the integrity and security of the external destinations to which Formcast forwards your data.
• Form Content: You must not use the Service to submit or transmit illegal, harmful, abusive, or otherwise objectionable content. You must not interfere with or disrupt the integrity or performance of the Service.

4. Data Ownership and Processing

• Ownership: You retain ownership of all form submission data collected through your account.
• Access & Deletion: You may access your data through your dashboard. To request deletion of your data, please contact support at formcast.io/help.
• Spam Filtering: To protect system integrity, Formcast uses automated tools and AI models to detect and block spam and abuse. Submission content may be processed for this purpose.

5. Plans, Billing, and Cancellations

• Free Plan: We offer a free tier with limited features.
• Paid Plans: Paid subscriptions are processed through Paddle and are available on a monthly or annual basis.
• Upgrades: Upgrades take effect immediately upon payment.
• Downgrades: Downgrades are applied at the end of the current billing cycle.
• Rate Limits: Reasonable rate limits are enforced to prevent system abuse. Excessive usage may result in throttling or temporary suspension.

6. Service Availability

While we strive to provide a reliable and performant service, we do not guarantee uninterrupted availability. The Service is provided “as is” without warranties of any kind. We reserve the right to perform maintenance or modify features at any time without notice.

7. Termination and Suspension

We may suspend or terminate your access to the Service, without notice, if:

• - You violate these Terms of Service
• - You use the Service for spam, abuse, or other disruptive activities
• - Required by law or legal process

Formcast also reserves the right to remove or disable any account that creates risk or legal exposure for us.

8. Support and Account Deletion

If you wish to close your account or request assistance, please contact support via formcast.io/help. Account deletion requests will be processed in a reasonable timeframe, subject to our data retention obligations.

9. Refund Policy

Due to the nature of digital services, all payments are non-refundable. You may cancel your subscription at any time, and you will retain access until the end of your billing period. We do not offer partial refunds for unused time or features. If you believe a charge was made in error, please contact us at formcast.io/help and we will review your case.

10. Modifications to This Agreement

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of the updated Terms. We will notify you of material changes through email or platform notifications.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Texas, and you consent to the personal jurisdiction of such courts.
